Form I-9 Completion for International Hires
Intended for: Departmental administrators who have responsibility for completing the I-9 process, or anyone who wants to learn more about employment authorization and the I-9 process for typical nonimmigrant classifications seen in academic settings.
Course description: This course focuses on Form I-9 completion for International Hires. Form I-9 completion is a critical step in the onboarding of new employees at UC San Diego; failure to follow federal I-9 procedures can put our institution at risk of non-compliance and penalties. The I-9 process is complicated, however, particularly when reviewing the documentation of non-U.S. workers in a variety of statuses sponsored at UC San Diego, such as H-1B, J-1, F-1, and TN, as all of these classifications have dramatically different paperwork; paperwork can even vary within a nonimmigrant classification, such as a J-1 scholar vs. a J-1 student. This class is unique in that it focuses on actual paperwork that international employees will provide as evidence of their employment authorization; it examines this paperwork in light of the instructions provided by our federal government in their “Employer Handbook M-274” and the Form I-9 instructions, for both initial hires and reverifications, as well as instructions for use of receipt notices.
Topics covered:- Review of Authoritative Sources for I-9 completion
- Examination of various I-9 employment authorization documents presented by H-1B and TN employees, J-1 students and scholars, F-1 students, and EAD card holders and how the USCIS “Employer’s Handbook M-274” discusses completion of the initial I-9 with this documentation
- Examination of various documents for the I-9 reverification process for international employees, including which receipt notices are acceptable
- Interactive examples through the introduction of case scenarios, which will require completion of the I-9 process done through work in small group formats
