After H-1B
The H-1B visa has a maximum duration of 6 years, which includes all cumulative time spent in the U.S. during a consecutive stay. For those who may wish or need to remain in the U.S. beyond this period, it is crucial to plan ahead. Please consult with your ISEO Scholar Advisor about the options listed below.
- Reclaiming H-1B time - Time spent outside the U.S. during your six years on H-1B status can be recaptured. To request this, follow the H-1B extension/amendment application instructions. You will need to provide evidence of your time spent outside the U.S., such as I-94 travel history, entry and exit stamps, boarding passes, and itineraries.
- Restarting H-1B time period - If you spend 1 continuous year outside the U.S., you may be eligible for a new 6-year period of H-1B status.
- Changing to Other Statuses - Most scholars transition to permanent residency after the H-1B status. However, if this is not your plan, please discuss alternative statuses with your advisor or new employer before you have completed the maximum allowed 6 years on H-1B status.
- Legal Permanent Residency - For faculty and scholars intending to stay in the U.S. long term, we recommend consulting with your ISEO Scholar advisor and an attorney to explore permanent residency options.
